Terms and

Conditions of supply

Last updated: 6 October 2026

These Terms and Conditions of Supply apply when you purchase goods or services from Landscaping Emporium.

Please read them carefully before placing an order. They explain who we are, how a contract is formed, payment and delivery arrangements, your cancellation and return rights, and the terms applying where we provide installation or other services.

Nothing in these terms affects any statutory rights that you have as a consumer.

1. Who We Are

Landscaping Emporium is operated by:

References in these terms to “Landscaping Emporium”, “Kirman Design”, “we”, “us” or “our” mean Andy Kirman trading as Kirman Design and Landscaping Emporium unless the context requires otherwise.

2. About These Terms

These terms apply to goods and services purchased from us through our website, by telephone or through another method where we tell you that these terms apply.

Some products or services may also have additional product-specific or project-specific terms.

Where additional terms apply, we will make these available to you before the relevant contract is concluded wherever required.

Please also read our Privacy Policy, which explains how we process personal information.

3. Consumer Rights

If you are purchasing as a consumer, you have legal rights in relation to goods and services.

Goods supplied by us must comply with applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and correspondence with their description.

Services supplied by us must be carried out with reasonable care and skill.

Nothing in these Terms and Conditions is intended to exclude or restrict any consumer right that cannot lawfully be excluded or restricted.

4. Placing an Order

When you place an order with us, you are offering to purchase the goods or services shown in your order subject to these terms.

Please check your order carefully before submitting it.

You are responsible for ensuring that information you provide to us is complete and accurate, including your name, contact details, delivery address and any measurements or site information requested from you.

After you place an online order, you may receive an automated acknowledgement confirming that we have received it.

An acknowledgement of receipt does not necessarily mean that we have accepted your order.

5. When a Contract Is Formed

A contract between you and us is formed when we expressly accept your order or otherwise confirm that we have accepted the contract.

For straightforward supply-only orders, this may occur when we send an order acceptance or dispatch confirmation.

For products requiring a site assessment, installation or further specification, acceptance may be subject to completion of the relevant assessment and confirmation that the proposed work is feasible.

We reserve the right to decline an order before a contract is formed where there is a legitimate reason to do so.

This could include circumstances where a product is unavailable, there has been an obvious pricing or description error, payment cannot be authorised, delivery cannot reasonably be made to the address supplied or an installation cannot reasonably or safely be undertaken.

If we decline an order after taking payment, we will refund the appropriate amount.

6. Prices

Prices are shown in pounds sterling (£).

Prices displayed to consumers include VAT where applicable unless expressly stated otherwise.

We take reasonable care to ensure prices shown on the website are accurate.

If we discover an obvious pricing error before accepting an order, we will contact you.

You will normally have the opportunity to proceed at the correct price or cancel the affected order.

We are not required to supply goods at a price that was obviously incorrect where the pricing error could reasonably have been recognised as an error.

7. Payment

The payment methods available will be shown during checkout or explained to you before the order is confirmed.

Payment may be required in full when an order is placed unless we expressly agree another payment arrangement.

Where an order involves installation, staged payments or another payment arrangement may apply if specified in the quotation, order confirmation or project-specific terms.

8. Product Availability

Products displayed on our website are subject to availability.

This is particularly important for plants, trees, hedging, natural materials, seasonal products, handmade products and items manufactured to order.

If something becomes unavailable after you place an order, we will contact you as soon as reasonably practicable.

Depending on the circumstances, we may offer a suitable alternative, a revised delivery date or a refund for the unavailable item.

We will not substitute a materially different product without your agreement.

9. Trees, Hedging and Other Living Plants

Trees, hedging, shrubs, perennials and other plants are living products.

Natural variation is therefore unavoidable.

Plants of the same species, variety and stated size may differ in shape, branching structure, foliage density, seasonal appearance and other natural characteristics.

Photographs on our website are representative and do not normally depict the exact individual plant that will be supplied unless we expressly state otherwise.

The appearance of deciduous plants also changes significantly through the seasons.

A deciduous tree supplied during winter, for example, may naturally have no leaves.

These natural characteristics are not, by themselves, defects.

This does not affect your statutory rights where goods are faulty, not as described or otherwise fail to conform to the contract.

10. Plant Sizes

Plant sizes shown on the website or in quotations are normally based on recognised horticultural measurements or nursery specifications.

Depending on the plant, this may include overall height, girth, rootball size, container size, clear stem height or another recognised measurement.

Because plants are living products, reasonable natural variation may occur.

If a precise dimension is essential to your project, please tell us before ordering so that we can confirm the appropriate specification.

11. Plant Establishment

Successful establishment after planting depends on factors including watering, soil conditions, drainage, weather, planting method, exposure, pests, diseases and ongoing maintenance.

We will provide or make available appropriate establishment guidance where relevant.

Our Looking After Newly Planted Trees and Hedging guidance provides further information.

You are responsible for appropriate ongoing maintenance after supply or installation unless a separate maintenance service has been agreed.

Nothing in this section removes your statutory rights if the plant was defective or otherwise failed to conform to the contract when supplied.

12. Natural Materials

Some products sold by Landscaping Emporium are manufactured from or incorporate natural materials.

Natural stone, timber, plants and similar materials can vary in colour, texture, markings, grain, dimensions and appearance.

These variations are part of the natural characteristics of the material and will not necessarily constitute a defect.

Natural stone may contain variations in tone, texture and markings.

Timber can change as environmental conditions change and may exhibit characteristics such as movement, shrinkage, swelling, knots and minor surface checking.

13. Porcelain and Manufactured Paving

Manufactured paving is generally more consistent than natural stone, but some variation may still occur between individual pieces and production batches.

Products designed to reproduce natural materials may deliberately incorporate multiple patterns or faces.

If you expect to extend a patio in the future, we recommend retaining spare paving from the original batch because a perfect colour match cannot necessarily be guaranteed between different production runs.

14. Product Images and Colours

We make reasonable efforts to display products accurately.

However, screens and devices reproduce colours differently, and photography can be affected by lighting and surrounding conditions.

Website images should therefore be treated as a reasonable representation rather than a guarantee of an exact colour match.

Where colour or texture is particularly important, please contact us before ordering.

15. Measurements Supplied by Customers

Where you provide measurements for paving, decking, screening, hedging or another product, you are responsible for taking reasonable care to ensure those measurements are accurate.

If we manufacture, order or allocate goods specifically on the basis of measurements supplied by you, incorrect measurements may affect whether the goods can be used.

Where our service includes a site assessment or professional measurement, the responsibilities will instead be determined by the scope of that service.

16. Patio and Project Calculators

Any online calculator or configurator is intended to help determine an appropriate product, specification or indicative project cost based on the information entered.

Results may be subject to verification.

Where a project requires a site assessment, the final specification may change after we inspect access, measurements, levels, drainage, ground conditions or other relevant factors.

We will explain any material changes before proceeding with additional work or charges requiring your agreement.

17. Site Assessments

Some installed products require a site assessment before installation can be confirmed.

Where a site-assessment charge applies, the amount and whether it is refundable will be made clear to you before you place the relevant order.

The purpose of the assessment may include confirming measurements, access, ground conditions, levels, drainage requirements and whether the proposed installation is reasonably practicable.

If the original proposal is unsuitable, we may recommend an alternative.

We will not proceed with a materially more expensive alternative without your agreement.

Where the original installation cannot reasonably be undertaken, any refund and site-assessment charge will be dealt with in accordance with the terms disclosed to you before purchase and your statutory rights.

18. Installation Services

Where your order includes installation, we will perform the agreed services with reasonable care and skill.

The precise scope of the installation will be described in the relevant product information, quotation, order confirmation or project specification.

Anything not expressly included should not be assumed to form part of the installation.

If unforeseen site conditions are discovered after work begins, we will explain the issue and any reasonably necessary change to the work.

Where that change would result in an additional charge, we will seek your agreement before undertaking the additional chargeable work except where immediate action is reasonably necessary for safety or to protect property.

19. Customer Responsibilities for Installation

You must provide reasonable access to the site at the agreed time.

You should tell us before installation about anything that could materially affect the work, including known underground services, drainage, private utilities, restricted access, structural problems or other relevant hazards.

Where necessary, you must also provide reasonable access to water and electricity if this has been agreed as part of the installation arrangements.

If we cannot carry out work because information supplied by you was materially inaccurate or reasonable access has not been provided, additional costs may arise.

We will explain those costs where applicable.

20. Underground Services

Landscaping work may involve excavation.

You should tell us about any private services, cables, pipes, drainage systems or other underground features that you know about and that may not reasonably be apparent.

Where specialist surveys or investigations are required, responsibility for arranging and paying for them will be agreed before work proceeds.

Nothing in this section removes our responsibility to exercise reasonable care and skill when carrying out installation work.

21. Weather and Ground Conditions

Landscaping work is affected by weather.

Heavy rain, frozen ground, extreme temperatures, high winds or other unsafe or unsuitable conditions may require installation to be postponed.

We may also need to alter the sequence of work where ground conditions make the planned programme impracticable.

Where this occurs, we will endeavour to keep you informed and rearrange the work within a reasonable period.

22. Delivery

Available delivery options and charges will normally be shown at checkout, on the product page or in your quotation.

Delivery costs may vary according to the product, quantity, weight, delivery location and access requirements.

Large trees, hedging, paving and other bulky products may require specialist delivery.

Where specialist delivery is required, we may contact you before dispatch to confirm access.

23. Delivery Dates

Any delivery date or time given before dispatch is an estimate unless we expressly agree that it is a guaranteed date or that delivery by a particular date is essential to the contract.

We will make reasonable efforts to deliver within the agreed or indicated period.

Your statutory rights in relation to delivery are unaffected.

24. Delivery Access

You are responsible for providing accurate information about delivery access.

For large or heavy products, this can include road width, gateways, overhead restrictions, parking restrictions, steps, slopes and the distance between the unloading point and intended location.

Large specimen trees, rootballed hedging, pallets of paving and similar products can be extremely heavy.

If you are uncertain whether access is suitable, please contact us before ordering.

25. Kerbside and Specialist Deliveries

Some products may be delivered by pallet network, specialist vehicle or another delivery method where unloading is limited to a suitable accessible point.

Where this applies, we will provide appropriate information before the contract is concluded where required.

The customer should not assume that a delivery driver will move heavy products through a property or garden unless that service has expressly been included.

26. Delivery Inspection

Please inspect goods as soon as reasonably possible after delivery.

If something appears damaged, incorrect or missing, contact us promptly and provide photographs where reasonably possible.

Prompt notification helps us investigate with the carrier or supplier.

However, a request that you notify us promptly does not remove or reduce any statutory rights you may have if goods are faulty, damaged, not as described or otherwise fail to conform to the contract.

27. Cancellation Rights for Consumers

If you are a consumer purchasing at a distance, you may have a statutory right to cancel your contract under the Consumer Contracts Regulations.

For many goods purchased online, the statutory cancellation period normally ends 14 days after the day on which you, or a person nominated by you other than the carrier, takes physical possession of the goods.

Different rules can apply to services, mixed contracts, multiple deliveries and certain categories of goods.

Your cancellation rights are subject to the statutory exceptions described below.

Nothing in these terms reduces any cancellation right provided to you by law.

28. Cancelling an Order Before Dispatch

If you wish to cancel or change an order, please contact us as quickly as possible.

Where you have a statutory or contractual right to cancel, we will deal with the cancellation accordingly.

Where goods have already been dispatched, manufactured to your specification or otherwise fall within a statutory exception, different provisions may apply.

Contact us at hello@landscapingemporium.co.uk or 01942 604976.

29. Bespoke and Made-to-Order Goods

Statutory cancellation rights may not apply to goods that are genuinely made to the consumer's specifications or clearly personalised, where the relevant legal exception applies.

A product is not automatically treated as bespoke simply because it forms part of a landscaping project.

Where we intend to rely on the made-to-order or personalised-goods exception, we will identify the relevant nature of the product before the contract is concluded.

Your rights where bespoke goods are faulty, not as described or otherwise fail to conform to the contract are unaffected.

30. Living and Perishable Goods

Certain goods that are liable to deteriorate or expire rapidly may be exempt from the statutory right to cancel a distance contract.

Whether that exception applies depends on the nature and circumstances of the particular goods.

We therefore do not rely on a blanket statement that every tree, hedge, shrub or perennial is automatically non-returnable simply because it is a plant.

Where a statutory cancellation exception applies, we will deal with the order in accordance with that exception.

Your rights in relation to faulty, misdescribed or non-conforming goods remain unaffected.

31. Services During the Cancellation Period

Where you ask us to begin a service during a statutory cancellation period, additional legal provisions may apply.

Where required, we will obtain your express request before beginning the service during that period.

If you subsequently exercise a valid cancellation right after requesting that work begin, you may be required to pay a proportionate amount for services properly supplied before cancellation, where the law permits.

Where a service has been fully performed within the cancellation period following the required express request and acknowledgement, the statutory cancellation right may be lost in accordance with applicable law.

32. Returns

If you wish to return goods, please contact us before sending them back so that we can explain the appropriate return procedure.

The return arrangements depend on why the goods are being returned and whether you are exercising a statutory cancellation right or returning goods because they are faulty, damaged, incorrect or otherwise do not conform to the contract.

Where you are responsible for return costs, we will make that clear in accordance with applicable law.

Where we are responsible for the goods being returned because they are faulty or incorrectly supplied, your statutory rights will apply.

33. Refunds

Where a refund is due, we will make it using the payment method required by applicable law or, where permitted, another method agreed with you.

Refunds will be made within the applicable statutory time limits.

Where deductions are legally permitted — for example, in relation to diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of goods — any deduction will be made only in accordance with applicable law.

34. Faulty Goods

If goods are faulty, not as described, not fit for purpose where the relevant legal requirements are satisfied, or otherwise fail to conform to the contract, please contact us.

We will deal with the matter in accordance with your statutory rights.

Those rights may include repair, replacement, price reduction, rejection or refund depending on the circumstances and applicable law.

Nothing in any product guarantee replaces or restricts these statutory rights.

35. Problems With Installation Services

If you believe there is a problem with installation work, please tell us as soon as reasonably possible.

This gives us an opportunity to inspect and investigate the issue.

Where a service has not been performed with reasonable care and skill or otherwise does not conform to the contract, we will deal with the matter in accordance with applicable consumer law.

Depending on the circumstances, statutory remedies can include repeat performance or an appropriate price reduction.

36. Commercial Guarantees

Some products or installation services may include an additional commercial guarantee.

Where a commercial guarantee applies, its duration, scope and exclusions will be stated in the relevant product information, quotation or guarantee documentation.

A commercial guarantee is additional to your statutory rights and does not replace them.

37. Plant Guarantees

Where we offer a specific plant-establishment or replacement guarantee, its terms will be provided separately.

Unless such a commercial guarantee is expressly offered, we do not guarantee that a healthy plant will survive indefinitely after supply or planting because establishment depends on subsequent watering, maintenance, weather, soil conditions, pests, disease and other factors outside our control.

This does not affect your statutory rights if a plant was faulty, misdescribed or otherwise failed to conform to the contract when supplied.

38. Changes to an Installation

You may ask us to change the agreed installation before or during the work.

We will tell you whether the proposed change is reasonably practicable and whether it affects the price or programme.

We are not obliged to carry out additional or materially different work unless it has been agreed.

Any significant change should be recorded in writing wherever practicable.

39. Unforeseen Site Conditions

Landscaping work can reveal conditions that were not reasonably apparent before excavation begins.

Examples may include buried structures, unsuitable fill, unexpected drainage, contaminated material, concealed foundations or underground services.

If an unforeseen condition materially affects the agreed work, we will explain the issue and discuss appropriate options with you.

Any additional chargeable work will normally require your agreement before proceeding.

40. Planning Permission and Other Consents

Unless expressly included within our agreed service, you are responsible for obtaining any planning permission, landlord consent, covenant approval or other permission required for the work.

If you are unsure whether consent is necessary, please raise this before work begins.

Where we expressly agree to obtain or advise upon a particular consent, the scope of that service will be set out separately.

41. Ownership of Goods

Ownership of goods will pass in accordance with the applicable contract and law.

Where goods are supplied as part of an installation project, any specific payment and ownership provisions contained in the relevant quotation or project agreement will also apply.

Nothing in this section affects statutory consumer protections.

42. Our Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

If you are a consumer, we are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable, except where the law provides otherwise.

43. Business Customers

If you purchase goods or services wholly or mainly for purposes relating to your trade, business, craft or profession, different legal rights may apply.

Where appropriate, additional business-to-business terms may be agreed separately.

Nothing in these consumer-focused provisions should be interpreted as granting a business customer statutory consumer rights that do not apply to that transaction.

44. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control where the law permits.

These may include severe weather, flooding, fire, major transport disruption, supplier failure caused by exceptional circumstances, government restrictions or similar events.

Where such an event materially affects your order, we will contact you and take reasonable steps to minimise the effect.

Your statutory rights, including any rights arising from excessive delay, remain unaffected.

45. Personal Information

We process personal information in accordance with our Privacy Policy.

We may need to provide relevant contact or delivery information to couriers, suppliers, subcontractors or other organisations involved in fulfilling your order.

Further information is provided in the Privacy Policy.

46. Complaints

We want to resolve problems fairly and promptly.

If you have a complaint about goods, delivery or installation, please contact:

Landscaping Emporium
Unit 9, Bridgewater Business Park
Gladstone Street
Blackburn
Lancashire
BB1 3DL

Email: hello@landscapingemporium.co.uk

Telephone: 01942 604976

Please provide your name, order number where applicable, a description of the problem and photographs where these would help us understand the issue.

47. Changes to These Terms

We may update these Terms and Conditions from time to time.

The terms applying to your contract will normally be those provided or made available to you when your contract was formed, together with any subsequent changes expressly agreed between us.

Updating the terms displayed on our website does not retrospectively alter an existing contract without an appropriate legal basis or agreement.

48. Severability

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.

49. Third-Party Rights

Unless expressly stated otherwise, these terms are between you and us.

No other person has a right to enforce them except where applicable law provides otherwise.

50. Governing Law and Jurisdiction

If you are a consumer, these terms and the contract between us are governed by English law.

The courts of England and Wales will have jurisdiction, although consumers resident in Scotland or Northern Ireland may also have rights to bring proceedings in the courts applicable to where they live.

For business customers, unless otherwise agreed in writing, the contract and any non-contractual disputes or claims arising from it are governed by English law and the courts of England and Wales will have exclusive jurisdiction, subject to any mandatory legal requirements.
